Ms Dereleen Elana James, MP, acting in accordance with section 73(2) of the Constitution of the Republic of South Africa, 1996, intends to introduce the Prevention and Combating of Corrupt Activities Amendment Bill, 2026, in Parliament.
The draft Bill seeks to:
• introduce mandatory minimum sentences for offences relating to corrupt activities, linked to the monetary value of the corruption involved ranging from five to eighteen years. This is to ensure consistent, proportionate, and deterrent penalties;
• lower the threshold for the mandatory reporting of corruption to strengthen accountability and transparency in both public and private institutions from R100 000 to R30 000.
Members of the public, civil society organisations, and other stakeholders are invited to submit written comments on the proposed content of the draft Bill within 30 days of this notice’s publication.
